Terms of Service

§ 1 Scope
These Terms of Service apply to all contracts between the operator of Turniermeister.at (hereinafter "Provider") and the user (hereinafter "Customer") regarding the use of the Turniermeister platform. Austrian law applies.
§ 2 Subject matter
The Provider offers the Customer a web-based platform for creating, managing and running tournaments (Software-as-a-Service). The scope of features depends on the selected plan.
§ 3 Registration and contract
Registration is done via an authentication service (Clerk) using a Google account, Apple account or email address. A contract for the use of the platform is concluded upon registration.
After registration, the Customer automatically receives a 14-day free trial with the features of the Pro plan. After the trial period, the Customer can choose a paid plan or continue using the platform with limited features.
§ 3a Right of withdrawal for consumers
Consumers as defined by the Austrian Consumer Protection Act (KSchG) have the right to withdraw from the contract within 14 days without giving any reason, in accordance with § 11 of the Austrian Distance and Off-Premises Transactions Act (FAGG). The withdrawal period begins on the day the contract is concluded.
To exercise your right of withdrawal, please inform us of your decision to withdraw from the contract by sending a clear statement by email to support@turniermeister.at.
If you have requested that the service begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of the right of withdrawal, in comparison with the full scope of services provided for in the contract.
§ 4 Plans and features
The following plans are available:
- Basic – 1 tournament per type, all modes (except long-term), unlimited teams and participants
- Pro – 15 tournaments per type, all modes (except long-term), statistics, CSV export, templates, sponsor logos, unlimited co-organizers
- Premium – 100 tournaments per type, all modes incl. long-term, advanced statistics, PDF export, live ticker, custom branding, email invitations, unlimited co-organizers

§ 5 Prices and payment
The prices valid at the time of booking apply. In accordance with § 6 (1) Z 27 UStG, no VAT is charged (small business exemption). The following billing models are available:
- Monthly – Monthly billing, cancellable at any time
- Yearly – Annual billing with discount
- One-time – One-time payment for one month of access
Payment processing is handled by Mollie (Mollie B.V., Netherlands). Accepted payment methods: credit and debit card, Apple Pay, PayPal, eps, SEPA bank transfer, Google Pay, SEPA direct debit and Pay by Bank.
§ 6 Cancellation and term
Monthly subscriptions can be cancelled at any time, effective at the end of the current billing period. Access remains until the end of the paid period.
Annual subscriptions do not auto-renew. After expiration, the Customer can purchase a new subscription.
One-time purchases grant one month of access from the purchase date and do not renew.
Cancellation can be done via account management in the application or by email to support@turniermeister.at.
§ 7 Customer obligations
The Customer agrees to:
- Provide truthful information during registration
- Keep login credentials confidential and not share them with third parties
- Not misuse the platform
- Not upload illegal content
- Not use the platform in a way that impairs its operation
§ 8 Availability
The Provider strives for the highest possible availability of the platform. 100% availability cannot be technically guaranteed. Maintenance work will be announced in advance when possible.
§ 9 Data protection
The processing of personal data is carried out in accordance with our Privacy Policy and in compliance with the GDPR.
§ 10 Liability
The Provider is fully liable for intent and gross negligence. In cases of slight negligence, the Provider is only liable for damages resulting from the breach of essential contractual obligations, limited to the foreseeable, contract-typical damage. In all other respects, liability is governed by the provisions of the Austrian Civil Code (ABGB).
The Provider is not liable for data loss caused by the Customer or for outages due to force majeure.
§ 11 Intellectual property
All rights to the platform, including software, design and content, remain with the Provider. The Customer receives a simple, non-transferable right of use for the duration of the contract.
Data entered by the Customer (tournaments, teams, results) remains the property of the Customer.
§ 12 Changes to the Terms
The Provider reserves the right to amend these Terms. Changes will be communicated to the Customer by email or within the application. If the Customer does not object within 30 days, the amended Terms are deemed accepted.
§ 13 Final provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is, to the extent legally permissible, the registered office of the Provider. Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
